TERMS

This agreement is between Jesse Myers of Jesse Harris Photography (operating in the state of Montana) and the client(s) listed below.

PARTICIPANTS

Participants include the clients and the photographer.

EVENT DETAILS

These vary based on the session or event type booked.

AGREEMENT

Session or event will take place at a location agreed upon prior to the session. Deliverables vary based on the session or event booked. Unless otherwise noted, session galleries are available two to four weeks following the session. Unless otherwise noted, wedding and event galleries are available eight to ten weeks following the event.

RETAINER FEE

Session and event retainer fees are non-refundable. In the case of a reschedule request, retainer fees may be transferred to another date, client, session, or event type at the photographer's discretion.

REMAINING BALANCE

For sessions, the remaining balance is due at the time of the session. For weddings, the remaining balance is due at least thirty days prior to the event. Deliverables will not be sent until payment has been received in full.

REFUNDS

Due to the time intensive nature of the work and the digital nature of the deliverables, payments are non-refundable.

FAILURE TO PERFORM

Client payments will only be refunded if the photographer is unable to complete the work as agreed above. The photographer will have no further liability with respect to this agreement.

NO SHOWS OR CANCELLATIONS

If the client does not show up for their scheduled session or chooses to cancel their session or event, the retainer fee is non-refundable. The session or event may be rescheduled at the photographer's discretion. The retainer fee may be transferrable to another session, event or client at the photographer's discretion. An additional retainer fee may be required.

LIABILITY

The client agrees to hold the photographer harmless for any personal injury which may occur as the client(s) poses or works with the photographer. Client agrees the photographer is under no obligation to capture any specific moment or pose during the session.

CREATIVE CONTROL

Images are edited at the photographer's discretion, and deliverables may not include all images shot. The photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the photographer's artistic standards.

ACCESS TO DOWNLOADS/DELIVERABLES

Client understands and agrees that the photographer is not required to maintain copies of the photos from the session for more than 60 days after the photos have been delivered to client.

SEVERABILITY

If any portion of the contract is changed or disregarded because it is unenforceable, the rest of the contract is still enforceable.
